Providers Australia – Provider Terms of Service & Subscription Policy

These Terms of Service (“Terms”) govern your access to and use of Providers Australia’s online advertising platform and services (“Services”). By registering as a Provider, creating an account, or purchasing a subscription, you agree to these Terms.

These Terms are a business-to-business (B2B) agreement between you (“Provider”) and Digital Providers Australia, also referred to as “Providers Australia” (“we”, “us”, “our”).


1. Services Overview

Providers Australia is a digital advertising platform that allows care and support Providers to promote their services to potential participants and the general public.

We are not care or support service providers, not a government body, and we do not:

- deliver, recommend, or endorse any care or support services;

- verify or certify Providers’ qualifications, registrations, or compliance;

- participate in any contract, arrangement, or service delivery between Providers and participants.

Providers are fully responsible for ensuring:

- all listings, details, and content are accurate, lawful, and not misleading;

- they are appropriately registered with governing bodies (e.g., NDIS Commission) and any relevant authorities before advertising;

- they maintain compliance with all industry, regulatory, and legal requirements.

Participants and viewers use our platform free of charge, purely to browse listings. We do not charge users for access and we are not responsible for their decisions, actions, or service outcomes.


2. Provider Accounts

- Providers must provide accurate business, contact, and registration details when creating an account and claiming a listing

- Providers are responsible for maintaining the confidentiality of their account login details.

- All activity under a Provider’s account is considered authorised by the Provider.


3. Subscriptions, Campaigns & Add-Ons

Base Paid Subscription Plans

- All Provider paid subscriptions are minimum 12-month contracts with monthly billing.

- Subscriptions automatically renew unless cancelled in accordance with these Terms.

Campaigns & Add-Ons

- Optional campaigns and promotional add-ons (e.g., homepage features, SEO boosts, email blasts) are charged separately.

- Campaigns and add-ons are non-refundable once activated.

Pricing & Payment

- Fees are as published on our website or agreed in writing.

- Monthly subscription fees are due in advance.

- Campaigns/add-ons may be invoiced upfront or at activation.


4. Cancellation Policy

Base Subscriptions

- Subscriptions have a minimum 12-month term.

- Early termination does not qualify for refunds, and the Provider remains liable for any remaining term unless otherwise agreed in writing.

Campaigns & Add-Ons

- All campaigns and add-ons are one-off or fixed-term and cannot be cancelled or refunded once live.

Non-Renewal

- Providers may request non-renewal of their subscription by providing 30 days’ written notice before the end of the current term.


5. Content & Acceptable Use

Providers are responsible for ensuring all listings and content:

- are accurate, lawful, and not misleading;

- comply with NDIS requirements, relevant governing authority standards, and Australian Consumer Law;

- do not make claims or representations they are not authorised to make.

Providers must not:

- upload malicious code or attempt to disrupt the Services;

- infringe on any intellectual property rights;

- misuse the platform for spam, scraping, or unauthorised resale.


6. Intellectual Property

- All software, design, branding, and platform content remain the property of Providers Australia.

- Providers grant us a non-exclusive, royalty-free licence to use their listing content, images, and branding for platform display, marketing, and promotions.


7. Service Availability & Liability

- We strive to maintain continuous service but do not guarantee uninterrupted uptime.

- Temporary outages or maintenance are not grounds for refunds.

Limitation of Liability

- Our total liability to any Provider is capped at one month of subscription fees.

- We are not liable for indirect, incidental, or consequential damages, including lost leads, reputation, service outcomes, or revenue.

- We are not liable to participants or viewers for any reliance on Provider content.


8. Privacy & Data

- We do not collect or store participant financial or medical details.

- We collect business contact details and listing data from Providers to operate and improve our Services.

- Our Privacy Policy forms part of these Terms.


9. Termination

We may suspend or terminate a Provider account if:

- payments are overdue;

- content violates our acceptable use rules, governing laws, or regulatory requirements;

- there is misuse of the platform.

Termination does not remove the Provider’s obligation to pay fees already incurred.


10. Governing Law & Entire Agreement

These Terms are governed by the laws of New South Wales, Australia.

These Terms represent the entire agreement between the Provider and Providers Australia and supersede all prior agreements or communications.


By creating an account, purchasing a subscription, or using our Services, you acknowledge that you have read, understood, and agree to these Terms.
